Abstract

Franchise is a business system that is distinctive or has the characteristics of a business in the field of trade or services, in the form of the type of product and the form of business, company identity (logo, design, brand, even including the clothing and appearance of company employees), marketing plans and operational assistance. The type of research data is secondary data with primary legal material and secondary legal material. The collection technique is library research. While the data analysis technique used is descriptive qualitative. From the results of the research and analysis . a franchise agreement is a form of agreement that involves the franchisor as the franchisor, the franchisee who receives the franchise and the Ministry of Industry and Trade that fosters the franchise industry. The legal relationship creates binding rights and obligations for franchisors and franchisees. The franchise agreement includes an anonymous or innocent agreement that is regulated outside the Civil Code.
