Abstract

Crimes of theft by violence committed by 2016-2018 children at the Ogan Komering Ilir (OKI) Regional police station have experienced a significant increase, due to the perpetrators of child abuse, the handling carried out by the detective is different from when the perpetrators are adults. The problem in this research is how is the role and what are the obstacles faced by investigators in the investigation of criminal acts of theft with violence by children. The research method used is juridical normative research, where this method uses the library approach, legislation (statue approach), and literature. The type of research data is secondary data with primary legal material and secondary legal material. The collection technique is library research. While the data analysis technique used is descriptive qualitative. From the results of the research and analysis, it can be concluded that the detective's role in investigating the crime of theft with violence committed by children at the OKI Regional Police is in accordance with Law No. 11 of 2012 concerning the Child Criminal Justice System, carried out without using official attributes. include an arrest warrant to be known by parents and guardians, endeavored to carry out an act as if the auxiliary investigator / investigator conducted a visit or friendship to the suspect's family, took the child to the police by placing the child in a position not flanked or between police officers and the role of religious and community leaders is included, and if the child is still in school, the teacher must be brought in. The obstacle is the limited number of SPPA-certified investigators, so that the investigation process is hampered. But in reality in the field due to the lack of investigators who are certified by the Criminal Justice System for Children, the investigation has not been carried out according to the law's order and is still carried out as an investigation of adults
